Best-Effort: Das ist absolut normal in Verträgen. Niemand wird sich bei so etwas das gesamte Risiko ans Bein binden, wenn es so viele Unwägbarkeiten gibt. Vorprodukte/Vorlieferanten, Aufbau/Skalierung der Produktionsanlagen, Produktionsausbeute usw. usf.
Zudem heißt das nicht, dass sich der Lieferant zurücklehnen und, wenn es schlecht läuft, einfach sagen kann Pech gehabt, sondern er ist verpflichtet alles zu unternehmen (best effort) was möglich ist, um den Vertrag zu erfüllen (in gewissen Grenzen, welche das sind bzw. wie die genauen Formulierungen im Vertrag sind, müsste man die EU/AZ fragen. Grob zur Einschätzung was mit "best effort"/"best endeavours" gemeint ist 1) 2))
